Do you have the requirements for a work permit in Canada?

February 18, 2021BY Admin

Canada Work Visa, or Work permit, is issued for a defined amount of time to qualifying overseas employees working in that country.  Read below to see the requirements for a work permit in Canada?

People need to apply for a work visa only after obtaining a job offer or employment contract from a Canadian employer. Employers must obtain from ESDC (Employment and Social Development Canada) an LMIA ( Labour Market Impact Assessment) that permits them to hire skilled foreign workers for occupations that Canadian citizens or permanent residents cannot fill.

Requirements for A Work Permit In Canada

Applicants need to submit evidence that they are willing to take up a job offer. The documents must be submitted in English. The Canada Work Permit Visa is suitable for temporary employees, foreign graduates from Canadian universities, businessmen and those in need of work in Canada.  No matter where you are applying, you must:

  • Provide to the immigration officer the proof that you will exit Canada when your work permit expires;
  • Show that you have enough money and resources to take care of yourself and your family members during your stay in Canada and get back home.
  • Beware of the law and have no record of illegal activity (we may ask you to give us a police clearance certificate),
  • Not to be a threat to the safety of Canada,
  • Be in good health and, if necessary, have a medical test.
  • Not intending to work for an employer whose status is “ineligible” on the list of employers that have failed to comply with the conditions;
  • Do not intend to work for an employer who offers striptease, erotic dance, escort services or erotic massages regularly, and
  • Provide the officer with any other documentation that they ask to prove that you can enter the country.

Different Types of work permits:

There are two forms of work permits issued by the Canadian authorities:

  1. An Open Work Permit
  2. An Employer-Specific Work Permit.

An open work permit practically allows you to work for any employer. This visa is not unique to the work, so applicants do not need an offer letter from the employer who paid the enforcement fee or a Labor Market Impact Assessment (LMIA).

With an open work visa, you can work for any company in Canada except those companies that do not comply with labour standards or perform services such as escort services, erotic massage or exotic dance.

The employer’s specific work permit, as the name implies, is a permit that allows you to work for a particular employer.

While the employer-specific work permit is for a single employer, the open work permit will come under specific requirements that will be written on it.

Dependent Job Visa

The Government of Canada permits immigration of family members within the category of dependent work permits. You could have the opportunity to have your spouse and children join you in Canada if you get offered a job from a Canadian employer and have an open work permit.

Your children would be able to attend Canadian educational institutions without needing to obtain separate study permits. Your partner would also be able to apply for an open work visa to work in Canada.
